We are seeking community feedback on a proposal to sell a section of Council land located between 8 and 10 Woodbyne Crescent, Mornington, and acquiring a new open space in return in the same area.
Council would sell the Land to an adjoining property owner in accordance with section 114 of the Local Government Act 2020 on the condition that they provide Council with a new public open space within the Woodbyne Crescent area (Replacement Open Space).
The Replacement Open Space must:
- Amount to at least the same area of land as the land being sold
- Be developed at the purchaser’s cost
- Include protection of existing high value vegetation
- Include installation of new park infrastructure to Council requirements.
Council is considering selling the Land to facilitate more housing development in the area, such as through the proposed “Woodbyne Residential Precinct” on land in Woodbyne Crescent and Albany Way. This proposed housing development is subject to a separate approval process under the Planning & Environment Act 1987 to rezone land subdivide the land known as “Planning Scheme Amendment C247morn”. All feedback will be considered by Council before any final decision is made about the proposed land sale.
